Use of Your Personal Information

Chic Festivals Ltd (on behalf of HardRockHell) is notified (registered) as a data controller under the Data Protection Act 1998. The Data Protection Act puts obligations on users of personal information and lays down principles for its use. Information has to be processed fairly and lawfully. This means you are entitled to know how we intend to use any information you provide. Chic Festivals Ltd will use the personal information that you provide us, to process your booking. If there are other members in your party, you must ensure that you inform them of the information about them, that you are providing to us and what we will use it for. You may also choose to provide us with information about your health or the health of members in your party to enable us to assist you with any special needs. This information will only be used for the specific purpose(s) for which you provide it to us. Where you have booked your tickets through a third party, or have asked us to book any additional facilities on your behalf, you should also refer to the agent/service provider's own data protection policy for details of how they will use your personal information.

HardRockHell, Chic Festivals Ltd and carefully selected third parties will also use your information for internal statistical, market research and records purposes. This information may be shared with other companies within the emc3i Ltd group. We also use your information to contact you about other holidays or services brought to you by Chic Festivals Ltd or our carefully selected trading partners. If you do not wish to receive such information please contact the Data Protection Officer, Chic Festivals Ltd, Apartado 642, San Antonio, 07820, Ibiza, Spain.

Booking your HardRockHell weekend

To pay for your HardRockHell ticket by debit or credit card online or over the telephone. We accept the following:
Delta, Switch, MasterCard and Visa for ticket payments.
American Express is not accepted.
At the time of booking we will require all names and address for everyone on the booking as well as:-

There will be a £5.00 per person charge added at the time of booking for credit card charges.

The contract

The contract takes effect when you confirm and make a payment for your booking with debit or credit card. The contract lasts until you and your party leave the event. A contract will come into existence between you and Chic Festivals Ltd when:

The contract binds you and all the members of your party including day visitors. It is your responsibility to ensure that all members of your party accept the terms and conditions of booking and the provisions contained in ‘Terms and Conditions'. Failure to disclose all relevant information or comply with these terms may lead to termination of the contract and loss of the booking.

Your reservation

Depending on the time of booking it may be possible to only pay a £30 deposit per person and then a final payment later or full payment at the time of booking. When you receive your confirmation of booking, please telephone the HardRockHell call centre on 08700 110034 if any of the details contained in it are incorrect. Deposit payments are non-refundable.

If you change your booking

If you wish to add more guests to a booking, you will not be charged an amendment fee. Any names changes will incur a £20 amendment fee. Any changes must be made at least 56 days before the start of the event by telephone to HardRockHell on 08700 110034. Where name changes are sought to be made within 56 days of the start of the event it will be charged at £40 per change.

If you cancel your booking

It may be necessary to cancel your tickets due to illness, accident or change of circumstances. If you have taken out insurance, payments arising from the cancellation will be covered in most cases. As soon as you know that you need to cancel, please email us on info@hardrockhell.com

Cancellation charges are calculated from the date we receive your instructions by email, please see below:

Time of booking to 57 days before the start of the HardRockHell Event : 50% Cancellation charge
Less than 56 days before the start of the HardRockHell Event: 100% Cancellation charge

If we make any major alterations to your booking

We try very hard to provide all facilities and entertainment as advertised on our website. It may, however be necessary to make some alterations in advance of the event. If such a change is necessary, we will endeavour to advise you in writing as soon as possible. See options listed below. Please see next section for minor or last minute alterations.

You will have the following options if we make a major change to your booking:

Force Majeure

If something changes due to Force majeure meaning circumstances beyond our control including (but not limited to) industrial disputes, natural disasters, fire, technical problems, bad weather and acts of government Chic Festivals can not be held responsible.

Minor alterations

Alterations such as the withdrawal of certain amenities, facilities, activities and entertainment, may be made by Chic Festivals for reasons beyond our control without any obligation or liability. The advertised line-up is correct at time of going to press and may be subject to change. Your ticket is to the event and not for one particular band or DJ.

Limitation of liability

Chic Festivals accepts responsibility for those arrangements which are within its control but cannot accept liability for any injury, loss or damage suffered by you or any member of your party unless one of the following applies:

For all claims (except death or personal injury caused by the negligence of Chic Festivals, their employees or agents) that arise from the non-performance or improper performance of terms in our contract, Chic Festivals may in its absolute discretion pay compensation that is reasonable in all circumstances.

Circumstances beyond our control

Except where we say differently elsewhere in these conditions, we can not pay any compensation, reimburse expenses, or cover losses for any amount or otherwise accept responsibility. When we refer to circumstances beyond our control, we mean any event that we, or the supplier in question, could not foresee or avoid, even after taking all reasonable care. Such circumstances will usually include, but are not limited to, war, terrorist activity, civil unrest, industrial dispute, bad weather (actual or threatened) and significant building work ongoing outside your accommodation, which is not known to us in advance of your departure date and building work from a third party (such as resort development)

Pricing

We guarantee that the price shown and agreed on your confirmation of booking for the accommodation, party size plus any supplements is the amount payable by you. Please note that all prices shown are inclusive of VAT at the rate of 17.5%.

The pricing for this event is per room. Guests who upgrade to VIP will be guaranteed Club accommodation. If the booking is not upgraded to VIP, no specific grade or type of accommodation can be confirmed and units will be allocated based on party size and availability.

Offers – Promotional availability

All our offers are subject to limited promotional availability. Offers will run out due to the popularity of this event. Please remember to quote the applicable offer code as this will help us to find the best price and offer available at the time.

Arrival & departure times

Your accommodation keys will be available from 12:00 on the day of arrival. Please bring your confirmation of booking with you.

On your departure day, we have booked you in for late checkout in which case you can check out at 3pm. Please return your keys to main reception.

You will be required to leave £100 security deposit on arrival. This is against any damages made to your room. This is then released on departure.

Express check-in and out is available to all bookings.

Express checkin – all guests to have pre registered with us and the lead passenger will be able to collect apartment keys, lanyards and wristbands for the whole party.

Express check-out – you will be able to checkout prior to security checks on your apartment. You will leave your keys at reception without any waiting time. When security has checked your apartment and no damages have been made, then the authorisation on your card will be released. If damages have been made – then you will be contacted and charged accordingly. Room keys not returned to reception on checkout will be charged at £10 per key.

Minimum age requirement

This event is strictly for guests over the age of 18. All guests are required to have proof of ID when arriving on site.

Proof of Age – This may be asked for when checking in or buying alcohol on Resort. ONLY PHOTOGRAPHIC ID WILL BE ACCEPTED including Passport, Drivers Licence, CitizenCard, VALIDATE UK, Connexions Card, Young Scot, or Proof of Age Card.

DO NOT COME TO THE SITE WITHOUT ID AS. No entry or refunds will be given if you are unable to prove your age. If you do not have any photographic ID, then visit www.citizencard.com

Pets

Pets are not permitted in the event. Assistance dogs are accepted by prior agreement, please call 08700 110034. We reserve the right to refuse any animal which is considered to be dangerous.

We need to know

Please note that only the guests listed on the confirmation of booking may occupy the accommodation. If any other person/ persons are found in occupation, HardRockHell will terminate the contract, the guests and unauthorised persons will be asked to leave the event immediately and refunds will not be given.

Health & safety

Contagious Diseases – Should anyone be diagnosed or suspected of having a contagious disease which has the potential to infect a large number of people in a short period of time, then they will be asked to leave the Resort, or if this is not possible, restrictions will be placed upon them to prevent the virus being transmitted to other guests. Please note that we are unable to offer refunds in such circumstances and we recommend you take out insurance to include sickness cover.

Disabled guests

If you have any special requirements or a member of your party has restricted mobility or access requirements please let us know at the time of booking. We will do our best to meet these requirements but advise they cannot always be guaranteed. If your special request is a necessity for you to be able to attend the Festivals, please contact the HardRockHell Call Centre for advice prior to making your booking on 08700 110034. Pontins has a limited number of units which have been modified for disabled guests and the facilities available do vary. It is therefore advisable to check the suitability of our accommodation prior to booking by calling the Helpline who will need to know the following information:

Without these details it is not possible for us to guarantee that suitable accommodation will be available. In which case, regrettably, we will be unable to accept the booking.

We should also point out that for safety reasons, certain venues within our Resorts may not be accessible for guests using wheelchairs, so please check when you book.

If you have a comment

If you are dissatisfied with any aspect of the event, in the first instance, please speak to a member of the HardRockHell team. If they are unable to resolve this issue, then please speak to the Guest Services team at your Resort. They will endeavour to help you immediately so that you can enjoy the rest of the event.

If at the end of the event, you feel that we have not dealt with your complaint satisfactorily, please write to the Correspondence Team no later than 28 days after the end of the event.

We are only able to take action on any complaints which are first brought to the attention of the Guest Services team whilst you are at the Festival and secondly received in writing within 28 days, unless there are exceptional circumstances.

General

Please show consideration to other guests and HardRockHell staff members at all times and treat the facilities with respect. Offensive or illegal behaviour and excessive noise will not be tolerated. If guests fail to comply with these rules, their contract may be terminated and they and their party will be asked to leave the Resort immediately (refunds will not be given).

Contracts will also be terminated if HardRockHell has a reasonable suspicion that any guest has committed, or intends to commit an offence.

Please treat your accommodation with care and respect. It will be inspected at the end of the event. You will be held responsible for any damage caused during your stay. Damage to the accommodation may also result in the termination of the contract with no compensation. On departure, please leave the accommodation in a clean and tidy condition. Please check your accommodation carefully prior to departure as we do not accept liability for items left behind upon your departure. We reserve the right to charge you during or after your stay for any loss or damage to our property. HardRockHell also reserves the right to enter accommodation at any time and for any reason to ensure the safety and well-being of our guests.

HardRockHell reserves the right to require any guest to be interviewed by us, on Pontins premises, to enable us to look into instances of damage or nuisance to Pontins property or guests. Any person who refuses to comply without a reasonable excuse will be treated as having terminated their contract. They and their party will be asked to leave immediately and refunds will not be given.

Guests are advised not to bring privately owned electrical appliances to any Resort. However, if guests do so, they use the equipment at their own risk.

Please be aware that some of our entertainment shows use strobe lighting. The availability of some outdoor facilities and entertainment may be affected by adverse weather conditions.

Any music played must be done so with all doors and windows closed to minimise disruption to the site neighbours. There is a sound curfew on site and guests are expected to adhere to it.

Failure to do so may result in your equipment being confiscated. This will be worked on a 3 strikes and you're out policy.

No Video camera's, professional photo cameras and/or recording devices are permitted into the venue at night without prior written consent. Please email all Press enquiries to info@chicibiza.com

Fireworks or flammable liquids will be confiscated upon discovery. Any use of fireworks or flammable liquids will result in immediate removal from the site, this includes flammable Poi.

Nitrous Oxide is a controlled substance and will be confiscated upon discovery.

WE OPERATE A ZERO TOLERANCE DRUG POLICY

Anyone found to be in possession of any suspected illegal or controlled substance risk arrest and prosecution. Further more you will be banned from attending any future HardRockHell events.

Whilst we allow unlimited amounts of food to be brought onto site we will only allow unopened packages, your alcohol allowance must also be brought onto site in unopened bottles/cans etc.

Searches whilst on site are a condition of stay and we reserve the right to enter any apartment without explanation.

Holiday Insurance; We strongly advise you to take out personal insurance to cover you for all eventualities which may occur during your stay and to cover any medical reason why you may have to cancel your booking.

In the event that we, in our sole opinion, feel that you have NOT left your accommodation exactly as you found it you will be subject to a charge for any cleaning or repairs necessary.

It is your responsibility to report any damages in your chalet on arrival to reception, otherwise you will be charged post event. When checking into your chalet the principle booker will be asked to sign an indemnity form taking responsibility for the upkeep of your room over the length of the Weekender.

If your conduct, or that of anyone in your party is detrimental to the smooth running of the event, we reserve the right to remove you and/or the rest of your party from the site without reason and without a refund.

TV filming & photography

Due to the popularity of this event, it will be screened live for TV. Please ensure that you are aware of the positioning of cameras at all times. We will not accept responsibility if contrary to your wishes, you appear on film or in photographs.
